2. Eligibility and Use of Website

You must be at least 18 years of age to place an order on the website. You agree to provide accurate, complete, and up to date information during registration and checkout. Summit Yak reserves the right to suspend or refuse service if inaccurate or misleading information is provided.

3. Nature of Outdoor Activities

Outdoor activities such as trekking, mountaineering, and adventure sports involve inherent risks, including injury, illness, loss, or death. By renting or purchasing gear from Summit Yak, you acknowledge that you participate in such activities at your own risk, Summit Yak does not guarantee safety or outcomes, and Summit Yak is not responsible for accidents, injuries, or losses arising during use of rented or purchased gear.

4. Rentals and Bookings

All rental bookings are subject to availability and successful payment. Rental duration, pricing, and security deposit details are displayed on product pages. Summit Yak reserves the right to cancel or modify a booking if gear does not meet quality or safety standards at the time of dispatch. In case of gear unavailability, the Summit Yak team will inform the customer and offer suitable alternatives or refunds as applicable.

5. Rental Period and Returns

Rental periods are calculated based on the dates selected during booking. Buffer days may be included for certain treks or partner bookings. Late returns beyond the agreed rental period may attract additional charges. Gear must be returned as per instructions shared with the order.

6. Delivery and Logistics

Gear may be delivered to the customer’s city or select trek starting points. Courier and pickup charges are borne by the customer unless stated otherwise. Delivery timelines may vary due to courier delays, weather, or regional accessibility. Summit Yak is not liable for delays caused by third party logistics providers or unforeseen circumstances.

7. Gear Usage and Responsibility

Customers agree that rented gear will be used only for its intended purpose, gear will not be altered, modified, sub leased, or lent to others, and gear will not be washed, repaired, or tampered with unless instructed. Normal wear and tear is acceptable. Any damage beyond this may attract repair or replacement charges.

8. Damage, Loss and Theft

All gear is inspected upon return. Costs for damage beyond normal wear and tear may be deducted from the security deposit. Loss or theft of gear may result in full deposit forfeiture or additional recovery charges. Summit Yak’s inspection and assessment will be considered final.

9. Security Deposit

Most rental items require a refundable security deposit. Deposits are refunded after gear return and successful inspection. Refund timelines may vary depending on inspection completion and payment method.

10. Cancellations and Refunds

All cancellations, refunds, and changes are governed by the Refund and Cancellation Policy. Rental fees and courier charges may be non refundable once gear is dispatched. No refunds are provided for early returns or unused rental days.

11. CB Partner Bookings

Special benefits may apply to participants booking through contracted partner companies. Eligibility for such benefits must be verified. Terms specific to CB Partner bookings will be communicated during confirmation.

12. Merchandise Purchases

Purchased merchandise is subject to item specific return or exchange policies. Used, damaged, or altered merchandise is not eligible for refund unless received defective.

13. Intellectual Property

All content on the Summit Yak website, including text, images, logos, and designs, is the intellectual property of Summit Yak. No content may be copied, reproduced, or used without prior written permission.

14. Limitation of Liability

To the maximum extent permitted by law, Summit Yak shall not be liable for indirect, incidental, or consequential damages. Liability, if any, shall not exceed the amount paid by the customer for the specific transaction.

15. Right to Refuse Service

Summit Yak reserves the right to refuse rentals or sales, cancel bookings, or decline future service in cases of policy violations, misuse of gear, or safety concerns.

16. Changes to Terms

Summit Yak may update these Terms and Conditions at any time. The version available on the website at the time of booking will apply.

17. Governing Law and Jurisdiction

These Terms and Conditions are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of India.
